What about other “conduct” issues?

The report identified a number of areas in which opportunistic conduct was a concern including:

  • Unforeseen capital expenditure
  • Unilateral contract variation
  • Attribution of legal costs
  • Confidentiality agreements
  • Franchisor-initiated changes to franchise agreements when a franchisee is trying to sell the business.

The Government has not decided how to deal with these pressure points and is appointing an Expert Panel to inquire into and advise on the appropriate measures to deal with these examples of inappropriate behaviour.
